However, the appearance of a physical product may vary slightly from images displayed on your device because of factors such as:

  • Screen settings;

  • Device type;

  • Lighting;

  • Photography;

  • Display calibration;

  • Manufacturing tolerances; or

  • Minor product improvements.

Product photographs are provided to help illustrate the product.

We do not guarantee that colors displayed on every screen will exactly match the physical product.

Where necessary, we may correct or update product descriptions, specifications, images or other information.

Nothing in this section limits your rights where a product is materially different from its description or otherwise fails to conform to the purchase contract.

6. Product Availability

All products are offered subject to availability.

Adding a product to your shopping cart does not reserve that product or guarantee that it will remain available.

A product may become unavailable between the time it is added to your cart and the time your order is processed.

If a product you ordered becomes unavailable, we may:

  • Cancel the affected product;

  • Contact you for instructions;

  • Offer an appropriate alternative where suitable; or

  • Refund amounts already paid for the unavailable product.

We will not substitute a materially different product without your agreement where such agreement is required by law.

7. Placing an Order

When you submit an order, you are making an offer to purchase the products selected in accordance with these Terms.

Please review all information carefully before submitting your order, including:

  • Products;

  • Quantities;

  • Prices;

  • Billing information;

  • Delivery address;

  • Contact information; and

  • Payment method.

An automatic order acknowledgement generally confirms that we have received your order. It does not necessarily mean that the order has been finally accepted.

A binding purchase agreement will normally be formed when we:

  • Send an order acceptance confirmation;

  • Confirm that the order has been dispatched; or

  • Otherwise expressly confirm acceptance of the order.

8. Order Changes and Cancellations

If you need to change or cancel an order, please contact us as soon as possible.

We will make reasonable efforts to assist you.

However, once an order has entered processing, fulfilment or shipment, we may no longer be able to modify or voluntarily cancel it.

This does not affect any statutory cancellation or withdrawal right that applies to your purchase.

9. Our Right to Refuse or Cancel an Order

We may refuse or cancel an order where reasonably necessary, including where:

  • A product is unavailable;

  • Payment cannot be authorized or verified;

  • Incorrect billing information has been provided;

  • Incorrect or incomplete delivery information has been provided;

  • Fraudulent or unauthorized activity is reasonably suspected;

  • An obvious pricing or product-information error has occurred;

  • An order exceeds applicable purchase limits;

  • Delivery is unavailable to the supplied address;

  • We reasonably believe the order is intended for unlawful resale or other unlawful activity; or

  • Processing the transaction would violate applicable law.

If we cancel an order after payment has already been collected, we will issue the appropriate refund.

10. Personal and Household Purchases

Unless otherwise expressly agreed, products sold through the Services are intended primarily for legitimate personal or household use.

You must not use the Services for:

  • Fraudulent transactions;

  • Unauthorized resale;

  • Unlawful export;

  • Sanctions evasion;

Where reasonably necessary, we may limit quantities or cancel suspicious orders.

The price payable will normally be the price displayed when you submit your order, subject to correction of obvious errors.

A change in price will not normally affect an order that has already been accepted, except where permitted by law in the case of an obvious pricing error.

The final amount payable will be displayed during checkout before you submit the order.

16. Shipping and Delivery

Shipping and delivery are governed by our Shipping Policy.

Delivery dates and delivery periods displayed through the Services are estimates unless expressly stated to be guaranteed.

Delivery may occasionally be delayed because of events including:

  • Carrier congestion;

  • Customs inspections;

  • Public holidays;

  • Severe weather;

  • Transportation disruption;

  • Strikes;

  • Regulatory restrictions;

  • Incorrect delivery information;

  • Natural disasters; or

You are responsible for providing an accurate and complete delivery address.

If delivery fails because the information supplied by you is incorrect or incomplete, you may be responsible for reasonable additional delivery or return costs where permitted by law.

For consumer orders, risk of loss or damage will generally pass to you when you, or a third party designated by you other than the carrier, physically receive the goods, subject to applicable law.

17. Returns and Refunds

Returns, exchanges and refunds are governed by our Return and Refund Policy.

We currently provide a voluntary 30-day return policy for eligible products, subject to the requirements and exceptions stated in that policy.

This commercial return policy is provided in addition to, and does not reduce, mandatory statutory consumer rights.

Please contact us before returning a product so that we can provide the appropriate return instructions.

18. EU/EEA 14-Day Right of Withdrawal

Consumers in the European Union or European Economic Area may have a statutory right to withdraw from an eligible distance purchase within 14 days without providing a reason, subject to applicable legal exceptions.

Where this statutory withdrawal right applies:

  • You must notify us of your decision before the applicable withdrawal period expires;

  • You must return the goods within the legally applicable period after notifying us;

  • You may inspect the product only to the extent reasonably necessary to establish its nature, characteristics and functioning; and

  • You may be responsible for a reduction in value resulting from handling beyond what is reasonably necessary.

For change-of-mind returns under the statutory right of withdrawal, the customer is responsible for the direct cost of returning the goods where this responsibility has been properly communicated before purchase.

Where the product is defective, damaged, incorrect or otherwise non-conforming, return costs will be handled in accordance with our Return and Refund Policy and applicable consumer law.

19. Refunds

Approved refunds will normally be issued using the payment method used for the original transaction unless:

  • Another method is agreed;

  • The original method cannot reasonably be used; or

  • Applicable law requires another method.

Refund processing time may depend on:

  • The reason for the refund;

  • The payment method;

  • When returned goods are received;

  • When acceptable proof of return is provided; and

  • The processing time of the relevant payment provider.

Where the statutory EU/EEA right of withdrawal applies, refunds will be processed within the applicable statutory period.

Where legally permitted, we may withhold reimbursement until:

  • The returned goods are received; or

  • You provide acceptable evidence that they have been sent back,

whichever occurs first.

Content made available through the Services may be protected by intellectual property laws.

  • Graphics;

Unless otherwise permitted by law or expressly authorized, you must not:

Nothing in these Terms transfers ownership of intellectual property to you.

Where the Services allow you to submit:

  • Ratings;

  • Comments;

  • Photographs;

  • Videos;

  • Suggestions;

  • Feedback; or

  • Other content,

you retain ownership of your original content.

By submitting content to us, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, translate, publish and display that content for legitimate purposes related to the Services, including:

  • Displaying customer reviews;

  • Operating the online store;

  • Improving products or services;

  • Responding to customer feedback; and

  • Promoting the Services.

You confirm that content submitted by you:

  • Is accurate to the best of your knowledge;

  • Is owned by you or used with permission;

  • Does not violate another person's intellectual property or privacy rights;

  • Is not unlawful or misleading;

  • Is not abusive, defamatory or obscene; and

  • Does not contain malicious software.

To the extent permitted by law, we are not responsible for losses caused exclusively by an independent third-party service outside our reasonable control.

24. Shopify

Our online store uses technology and e-commerce infrastructure provided by Shopify.

Products purchased through our online store are purchased from Calculator v/Kim Peter Jensen, unless expressly stated otherwise.

Shopify provides the technical platform and is not the seller of products offered by us.

Shopify may independently process certain personal information necessary to operate and secure its services, as further explained in our Privacy Policy and Shopify's applicable privacy documentation.

25. Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Our Privacy Policy explains, among other matters:

  • What information may be collected;

  • How information may be collected;

  • Why information is processed;

  • How it may be shared;

  • How long it may be retained;

  • How international transfers may be handled; and

  • What privacy rights may be available.

By using the Services, you acknowledge that personal information may be processed as described in the Privacy Policy.

Nothing in this section limits mandatory consumer rights.

  • Otherwise violates these Terms.

We may use reasonable technical measures to prevent automated activity that creates material security, privacy, operational or intellectual property risks.

29. Suspension or Termination

We may suspend or terminate access to some or all of the Services where reasonably necessary because:

  • These Terms have been materially violated;

  • Fraud or unlawful activity is reasonably suspected;

  • A payment remains lawfully unpaid;

  • Website or account security has been threatened;

  • A user presents a material risk to others; or

  • We are legally required to do so.

Where reasonably possible and appropriate, we may provide notice before suspension or termination.

Termination does not affect rights and obligations that arose before termination.

30. Availability of the Services

We take reasonable measures to keep the Services available, secure and accurate.

However, we cannot guarantee that the Services will always be:

  • Uninterrupted;

  • Free from technical faults;

  • Available at all times;

  • Compatible with every device or browser; or

  • Free from temporary errors.

We may temporarily suspend access for:

  • Security updates;

  • Technical upgrades;

  • System failures;

  • Emergency repairs; or

  • Other legitimate operational reasons.

Nothing in this section limits obligations that cannot legally be excluded.

31. Limitation of Liability

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special or consequential losses that were not reasonably foreseeable when the relevant contract was formed.

Such losses may include:

  • Loss of profit;

  • Loss of revenue;

  • Loss of business opportunities;

  • Loss of data; or

  • Other indirect commercial losses.

Nothing in these Terms excludes or limits liability where liability cannot legally be excluded or limited, including where applicable for:

  • Fraud;

  • Fraudulent misrepresentation;

  • Intentional misconduct;

  • Death or personal injury caused by negligence;

  • Gross negligence where liability cannot legally be limited;

  • Mandatory product liability;

  • Violation of non-waivable consumer rights; or

  • Any other liability that cannot legally be excluded.

Your statutory consumer rights remain unaffected.

32. Your Responsibility for Breaches

To the extent permitted by applicable law, you may be responsible for reasonable losses or claims resulting directly from:

  • Your unlawful use of the Services;

  • A material breach of these Terms;

  • Your infringement of another person's rights; or

  • Content submitted by you without necessary rights or authorization.

You will not be responsible for losses resulting from our own breach, negligence or unlawful conduct.

33. Events Outside Our Reasonable Control

We are not responsible for failures or delays caused solely by circumstances outside our reasonable control.

Such circumstances may include:

  • Natural disasters;

  • Extreme weather;

  • War;

  • Civil unrest;

  • Government action;

  • Epidemics or public-health emergencies;

  • Strikes;

  • Transportation interruptions;

  • Telecommunications failures;

  • Power outages;

  • Customs restrictions; or

  • Failures of essential third-party infrastructure.

Where such an event affects an order, we will take reasonable steps to reduce its impact where possible.

Mandatory consumer rights remain unaffected.

34. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be applied to the maximum extent legally permitted.

The invalid portion will be separated from the remaining Terms where necessary.

The remaining provisions will continue in full force.

35. No Waiver

If we delay or fail to enforce a right under these Terms, this does not automatically mean that we have waived that right.

Any waiver applies only to the specific matter for which it is given.

36. Entire Agreement

These Terms, together with the policies incorporated into them by reference, constitute the agreement governing your use of the Services and purchases from us.

Nothing in this provision excludes any statement, representation, warranty or information that legally forms part of a consumer contract.

37. Assignment

You may not transfer your customer account or contractual obligations to another person without our prior approval, except where applicable law gives you the right to do so.

We may transfer our rights or obligations as part of a legitimate:

  • Business sale;

  • Merger;

  • Restructuring;

  • Financing arrangement; or

  • Transfer of assets.

Any such transfer will not reduce your mandatory consumer rights.

38. Changes to These Terms

We may update these Terms from time to time to reflect:

  • Changes in applicable law;

  • Changes to the Services;

  • Changes to Shopify functionality;

  • Changes to payment or delivery systems;

  • Security requirements;

  • Changes in our business operations; or

  • Other legitimate operational reasons.

The current version of these Terms will be made available through the online store.

Changes will not retroactively remove consumer rights that have already arisen from an accepted order.

Where legally required, material changes will be communicated appropriately.

39. Governing Law and Disputes

These Terms and purchases made through our online store are governed by the laws of Denmark, subject to applicable mandatory consumer protection law.

If you are a consumer residing in another country, this choice of law does not remove any mandatory consumer protections that you are entitled to under the laws applicable to you.

If a dispute arises, we encourage you to contact us first so that we can attempt to resolve the matter directly.

Where a dispute cannot be resolved directly, you may have the right to submit the matter to:

  • An appropriate consumer dispute resolution body; or

  • A competent court having jurisdiction under applicable law.

Nothing in these Terms requires a consumer to waive any right to bring a claim before a court that has jurisdiction under applicable consumer law.
